No safety in numbers for speeding riders

Riders who believe there is safety in numbers may be in for a shock when the whole group is pulled over by police and fined for speeding.

The issue was brought to our attention when three of a group of four Brisbane riders were recently pulled over and fined for speeding.

One of the riders decided to challenge the fine because he believed he was not doing the same speed as the others.

His lawyer advised hima group of motorcyclist travelling together can be reasonably considered as all travelling at the same speed, therefore the police only need to confirm one was speeding to be able to apply the same ticket to the rest of the group”.

The rider’s challenge was unsuccessful in Magistrates Court this week.

Queensland Police officer Senior Constable John Wilkins used an in-car radar to record the speed of three of the riders as they approached in the opposite direction to which he was travelling. He missed the fourth rider.No safety in numbers for speeding riders

To back up his observations of each rider’s speed, he used a bodycam to record the vision of the riders and a partial view of their speed on the dashboard-mounted radar unit.

Proving the speeds of several riders in a group seems impossible, yet the Magistrate in this case accepted the police evidence.

The defendant, who has already spent $5500 on the matter, plans to take it further.

Many riders may have similar stories of numbers of riders copping the same speeding fine while others may have examples of only one rider being pulled out of a group for speeding.

Both scenarios seem unfair and unjust.

Except for fixed speed cameras, which can pick up individual number plates to issue fines, there does not appear to be any mobile equipment that can do the same.

In this case, the officer backs up his evidence with bodycam video.

We asked police in each state about their operations and policy.

Only Victoria, Queensland and South Australia replied, while the others refused to comment on operational procedures or “hypothetical situations”.

Victorian Police say that “under the right circumstances it is possible for police to intercept and issue speeding infringements to a large group of motorcyclists”.

However, they won’t say what those “right circumstances” are.

It seems police are simply willing to fine group riders and accept the chance that it may be challenged in court.

Queensland Police utilise multiple types of speed detection devices that are capable of accurately detecting motorists exceeding the speed limit.  Police remind all road users to drive safely and not exceed the speed limit. A handheld laser speed detection device will enable accurate targeting of an individual vehicle travelling in a group of vehicles. A mobile radar will not allow the individual targeting of a vehicle travelling in a group of vehicles, however it does have a feature that will allow the device to display both the strongest signal returned and the fastest vehicle detected. With regards to both types of devices, it is incumbent upon the operator to make visual observations as part of a valid tracking history to confirm the speed detected is accurate. The observations of the officer are vital in supporting any prosecution.

SAPOL uses both hand-held laser and vehicle mounted radar devices to detect speeds, along with officers observations of vehicles. A laser device could be used to detect speed of a motor cycle rider in a group.  The detection could be used to prove that other persons in the group were exceeding the speed limit, if they were observed by police as travelling parallel to each other.”

1. Manufacturer financing

You can make some saving by taking out a loan on your own before visiting the dealership. Motorcycle loans are available at several banks and credit unions and they tend to charge lower rates than the dealerships.

If your credit score is low or don’t have an impressive credit history, seeking a loan from a credit union can be an intelligent option. Credit unions, unlike banks, are nonprofit financial entities and might offer loans on easy terms. Fear of liability may prevent first aid for crashed riders

Crash witnesses are sometimes too scared of being sued to provide first-aid or assistance to crashed riders, says paramedic Michael Beak of First Bike on the Scene Australia.

“There is a lot of misinformation about the legalities of helping a crash victim on social media,” he says.

“I put in a lot of effort to reassure people during my courses that the chances of being sued is virtually zero.”

The First Bike on Scene course was originally developed by Paramedics working in the North West Ambulance Service (UK) in 2003/4. 

“Due to the nature of their work and being bikers themselves, they realised the need for a medical emergency care course appropriate to the needs of injured motorcyclists,” Michael says.

He is now offering the course in Australia and is looking for like-minded paramedics to join him.

“What’s different about First Bike on Scene is that emergency response skills are delivered by registered operational paramedics only,” he says.

“So students are taught skills that are evidence-based medicine, world’s best practice and comply with Australian Resuscitation Council (ARC) Guidelines.

“Paramedics are the experts in pre-hospital emergency care. It’s what they train for, it’s what they do for the duration of their operational career.”

Michael is a Mt Tamborine resident, Army Reserve medic of 10 years, Honda FVR750 rider and operational paramedic for 25 years.

He has been teaching first-aid for almost 30 years and started a first-aid training business (www.surefirefirstaid.com.au) eight years ago.

“Unfortunately, I have attended my fair share of motorcycle-related incidents,” he says.

Michael raced 250cc production and historic motorbikes in the late 1980s when he was a teenager and worked in Phil Beaumont’s motorcycle shop in Newstead, Brisbane.

“I was like a kid in a candy shop,” he says.

“I’ve crashed and broken a lot of bones in my years of riding, but when I broke my collar bone five years ago at walking pace on my Honda XR250 at a motocross park I was off work for 10 weeks and decided I needed a back-up plan.

“That’s when I decided to launch my own first-aid training centre and First Bike on the Scene is one of my specialty divisions.”

He says the courses are open to all riders and cost from $85 for the stand-alone course up to more advanced courses.

They will be launched in South East Queensland with the intention of spreading around the nation as registered paramedics are recruited.

The FBoS introductory course includes crash scene management, airway management, injury assessment, head and neck (c-spine) injury management, bleeding control, recognition of catastrophic bleeding, safe helmet removal in special circumstances, log roll and trauma CPR.

Michael says the most important feature of a first-care provider is that they take charge at a crash scene. 

“Even if it’s ‘fake it until you make it’, you have to convince everyone present that you know what you are doing, be confident and, if necessary, even assertive. Then people are happy to follow,” he says.

“The other important thing is that they think about the danger of other traffic. 

“There have been untold times I’ve been at a crash and you suddenly hear the locking up of brakes.

“A couple of times people have even skidded into emergency trucks. It’s like a moth to a light when they see the flashing lights. You go where you look.”

Can I transfer a number plate to a motorbike?

Whether you want to transfer your private number plate from car to car, motorbike to another motorbike or in-between the two, all of these options are possible and the same rules apply for each.

As long as the vehicle is subject to an annual test there are no restrictions to transferring your number plate from one vehicle to another, whether it be a car, bike, van or anything in-between.

There are however, exceptions to this rule. Vehicles that do not take part in an MOT are not able to be part of the DVLA Cherished Transfer Scheme, meaning that their number plates cannot be transferred. Examples of these vehicles are tractors, milk floats and other specialist vehicles.

Transfer fee

The usual price to transfer a private number plate is £80, however the DVLA will charge you differently depending on whether your transfer is on a certificate or from one vehicle to another.

How to transfer a private number plate to a motorbike

If the number plate that you want to transfer is already on a vehicle then you will have to complete a V317 form and submit it to the DVLA, along with documents for both vehicles that are involved in the transfer. You will also have to ensure that both vehicles are taxed and have a valid MOT so that the vehicles can be moved to be inspected by the DVLA if necessary. Along with this, you will have to make sure you pay the correct fees in order for the transfer to take place.

If the private number plate is not already on a vehicle and instead on a V778 Retention Document or V750 Certificate of Entitlement, you can then transfer the plate directly to your vehicle. When checking the certificate, if it is not in your name or you are not a named ‘nominee’ then you will have to change the nominee name, which is free of charge. You can check the costs and instructions for the transfer process on both certificates.

How to transfer a private number plate from a motorbike

If you’re wanting to transfer a private number plate from a motorbike to another vehicle then the same rules apply. You will have to process your application through the DVLA to remove the registration from your motorbike and onto a different vehicle. But, if you don’t have another vehicle to transfer the plate over to, whether that be because you’re saving it for a new vehicle or wanting to sell the plate at a later date then this is also possible. You will have to put your number plate on retention using a V778 Retention Document which lasts up to 10 years and can be renewed at no extra cost if you continue to keep your plate on retention.

If you want to sell the plate on the same rules apply. You can do so through auction sites, the DVLA or private selling sites such as NewReg.co.uk. Both parties will have to have the relevant documents available to send off to the DVLA in order to meet the legal requirements for the transfer.

How long does the transfer take?

The process of a number plate transfer can take anything between 2-5 weeks from when you submit the documents to the DVLA. In order to ensure that there are no delays or set-backs to the process, read through everything carefully to make sure that there are no mistakes in your application. Once the application has been approved and the plate transfer has taken place, you are free to enjoy your new private number plate.

Are you leaving enough gap in front?

Many riders are taught to leave a two or three-second gap between their bike and the vehicle they are a following as a safety buffer. But is it really enough? Is there such a thing as leaving too much space?

How to judge gap

We are taught to use a visible roadside reference to determine our following distance.

It works like this: As the vehicle in front passes a landmark (such as a light post, sign or tree), we start counting “1000, 2000, 3000” by which time our bike will pass the same roadside landmark.

That’s a three-second gap.

It’s much easier than trying to estimate distance and it’s easier, because the distance naturally increases the faster you are riding.

However, is a two-second or three-second gap enough?

The problem is there are several variables.

First is the vehicle in front. If it’s a late-model car, it will stop quite quickly.

Older cars, trucks, vans and laden utes cars will not be able to stop as quickly, so two seconds might be fine. However, be aware of any unsecured loads that could fall off a truck or ute.

Second is your motorcycle. How are its brakes?

There is a substantial difference between motorcycle stopping abilities, depending on many variables such as weight, tyres, suspension, brake discs, callipers, ABS, linked brakes and even the brake lines (hydraulic or cable).

(ABS may not make some riders stop any shorter, but it will allow the rider to steer out of harm’s way.)

Assessing space

To assess your bike’s braking abilities, find a quiet piece of road or carpark to practise your emergency stopping.

Take a friend and get them to measure how far it takes you to stop from various speeds.

Once you have the distance for each speed, compare it with how far you travel at that speed.

For example, at 100km/h you travel 28m a second, so your two-second gap leaves 56m to safely stop and three seconds leaves 84m.

Here is a list showing distance travelled at various speeds with stopping distances for 2- and 3-second gaps:

  • 40km/h  = 11m/second = 22m (2second gap) = 33m (3 seconds)
  • 50km/h  = 13.8m/s = 27.6m (2s) = 41.4m (3s)
  • 60km/h  = 16.6m/s = 33.2m (2s) = 49.8m (3s)
  • 70km/h  = 19.4m/s = 38.8m (2s) = 58.2m (3s)
  • 80km/h  = 22.2m/s = 44.4m (2s) = 66.6m (3s)
  • 90km/h  = 25.0m/s  = 50.0m (2s) = 75m (3s)
  • 100km/h = 27.7m/s = 58.4m (2s) = 83.1m (3s)
  • 110km/h = 30.5m/s = 61.0m (2s) = 91.5m (3s)
  • 120km/h = 33.3m/s = 66.6m (2s) = 99.9m (3s)
  • 130km/h = 36.1m/s = 72.4m (2s) = 108.3m (3s)

If your measured stopping distance at those speeds is more, then you may need to consider lengthening your gap.

Don’t overdo gap

However, don’t be too alarmed and add several seconds, because there are two more variables to consider.

The first is the fact that if you leave a big gap between you and the vehicle in front, another vehicle is likely to slot in which means you have to pull back even further.

If they jump in suddenly and then stomp on the brakes, it’s only creating more danger.

Also, the vehicle in front will not stop immediately when they apply their brakes. They also have stopping distances that vary with speed.

Danger in lane filtering around trucks

Lane filtering around trucks can be dangerous simply because riders can be invisible to the truck driver, even if you are right in front!

The Goldwing World Facebook page published the above photograph claiming all the bikes in the photo are in the truck’s blind spots.

It has been shared on many occasions. But notice that one of the positions where riders cannot be seen is right in front of the truck.

I have witnessed riders filter to the front of a line of traffic and then move across to sit in the lane in front of a prime mover.

The truck driver could be totally unaware of the presence of the rider.

So if the rider stalls when the lights turn green, what’s stopping the driver from running over the top of you if you happen to stall?

Or if the rider is distracted and misses the change of lights and the truckie is keen to get going … splat!

Despite the dangers of trucks to lane filtering riders, only the ACT prohibits lane filtering next to buses and trucks.

There is no mention in the official lane filtering rules for Queensland, NSW, SA, Victoria or Tasmania.

However, they all suggest in their explanatory notes riders “should avoid” filtering next to buses and heavy vehicles.

It should also be noted that an overriding rule is that riders must lane filter only “when safe to do so” (or similar words).

This is mentioned in Victoria, SA, ACT, Queensland and Tasmania, but not NSW,

It not only puts the onus on the rider to act responsibly and safely, but also provides police with some latitude to fine riders based on their judgement.

Onus on trucks

While riders should always take responsibility for their own safety, there is also an onus on truck drivers and other motorists to share the road with all vehicles, including motorcycles.

London has taken it further, banning trucks (lorries) over 3.5 tonnes that do not have special extended mirrors to reduce blind spots.

Drivers with a non-complaint vehicle face a £50 Fixed Penalty Notice and potential fine of £1000 in the Magistrates Court.

Similar legislation would be most welcome here in Australia.

RACQ safety officer and Suzuki Bandit fan Steve Spalding says blind spots around large vehicles are “a very risky situation for riders”.

“If there are ways to improve the types of mirrors fitted, or have better placement of existing ones, then we’d like to see heavy vehicle operators make those changes,” he says.

“Riders have to be aware of their vulnerability at all times but particularly when in congested traffic and around large and heavy vehicles because it can be difficult for truck drivers to cover all the blind spots.”

However, the truck mirror legislation would not have helped the London rider in this video which has gone viral. He was in front of the driver!

More blind spots

One of the big problems with riding near trucks, buses and other big vehicles is that their blind sports are not the same.

Fixed vehicles such as vans and buses/coaches have different blind spots to B doubles or prime movers with trailers. There are also extra blind spots for trucks with hoods (eg Mack) rather than cab-over trucks (eg Hino) with flat fronts.

We spoke with several bus and truck drivers and they say they don’t have a lot of problems with riders, but agree that there is potential for riders to get lost in blind spots.

For fixed vehicles, the worst blind spot is close on the inside (left in RHD countries and right for LHD countries) of the vehicle. Most heavy vehicles have blind-spot mirrors, but fast-accelerating bikes can zoom into view so quickly on a slow-moving vehicle, the driver may not have had a chance to see them.

Prime movers also have the problem that when they turn, their mirrors, which are fixed to the prime mover, show only a view of the trailer on one side and a wide view on the other, creating a massive blind spot area.

For trucks with a big bonnet, almost every near position from the mirrors forward is a blind spot, especially by the inside fender.

Drivers say riders can slip into the gap in front of a truck without them seeing the bike, which could result in a rear-ender as they approach a red traffic light.

They also claim that when the lights turn green, a gap opens up in front of slow-moving trucks and riders tend to slip into that gap where they may not be seen.

Wide berth

Motorcycles need to give trucks a wide berth on all angles in all traffic situations.

And don’t hope that your loud exhaust will alert the truck driver to your presence.

Most truck cabins are loud because the driver is sitting over the engine and is probably playing music or their CB radio over the top.

They will not hear you until you have passed them.

Sucked in

Bus and truck drivers also warn about the aerodynamic effects of following and riding too close to their vehicles.

Vehicles such as buses and some trailers with carriages low to the ground tend to create a vacuum at highway speeds that can suck a light bike toward them and potentially under their wheels.

Other trailers can push riders away into oncoming traffic. Some trailers, such as those carrying vehicles, create so much turbulence it can send a light bike into a tank slapper.

The effect is worse if the rider follows too closely before overtaking as they cop a sudden blast as they draw up alongside.

Dead-end roads are a rider’s paradise

Most riders love a good round-trip, but there are many dead-end routes that can be just as rewarding for motorcyclists.

I’ve been riding with people who never venture down a road that says “No through road”.

They figure that it will be like doing the road twice.

Yet I’ve ridden on famous motorcycling roads such as Mt Glorious Rd, the GOR, Putty Road, Big Sur (USA), etc, in both directions and it feels almost like two completely separate trips.

As they say, motorcycling is not about the destination, but the journey.

Who cares if the journey doesn’t have a destination, at all?

In fact, most destinations are a return to your home, anyway.

MBW reader Tee Jay summed it up perfectly in this Facebook post:

If you think riding up and down the highway is freedom and it doesn’t get any better, then think again. SEQ’s (South East Queensland’s) back roads and dead ends are where the proper motorcyclists go.

The same goes for just about anywhere in the world.

Our tip for great rides is to look for dead-end valleys.

We recently used our TomTom Rider 550 GPS units to navigate three valleys south of Laidley in SEQ which go nowhere.

However, the deeper we rode into the valleys, the closer the mountains and stunning scenery became.

And more importantly, the roads get twister and twister.

For those who know the area this is the Ropeley Rockside Rd

If you’re game, there is often a dirt road that will wind over the hills near the end of the valley to link to the next valley.

These SEQ valleys are only 40 minutes from the city, yet you feel like you are a million kays from home.

We were surprised at what we saw along the way: pecan plantations, camels, scenic creeks, stunning rock formations and more.

If you plan to do this ride on your own, wth friends or a group, you can stop for lunch at the pubs in Mulgowie (McGrath Crossing) or Upper Tenthill.

Tee also supplies this tip for those who don’t want to venture too far from the city.

“Go where the wealthy folks live. Their roads are brilliant. From Dayboro you can spend an hour going down two roads that end in dirt and return for coffee. How convenient is that? Do it before 10am because the sunshine through the trees is just; well it’s all part of the experience.”

I have another nearby favourite that I use to test the suspension on bikes I have for review: Upper Brookfield Rd.

It’s only 10 minutes from home and it winds through some very wealthy areas.

The road is tight and twisty, it has concrete dips that cross creeks, there are on-and-off-camber corners, the greenery is stunning and there is hardly any traffic.

At the 60km/h posted speed limit it’s still great fun.

Phone, camera, GPS and bike could incriminate you

If you’ve crashed or been stopped by police who suspect you’ve been doing something illegal, your action camera, phone, GPS and bike could help incriminate you.

Each of these items can contain the evidence police and the courts need to convict you for a traffic or criminal offence.

Phones are the most likely to be confiscated, but we have also heard of police confiscating action cameras.

Motorcycle Riders Association of WA safety officer Dave Wright has defended police for confiscating a Perth rider’s GoPro helmet cam SD card.

“If people are doing stupid things, they should pay the price,” he says.

In the latest case, a helmet camera from a dead rider has this month helped convict a British motorcyclist of dangerous driving.

His conviction was based on video evidence confiscated from the helmet of a riding colleague who died in a crash last year.

Police can also get vital evidence from GPS devices that record fastest and elapsed times.

They can also obtain incriminating evidence from motorcycles that feature data loggers.

What rights do you have?

So what do you do if police ask for an item that could incriminate you?

In some places, such as America, police may first have to obtain a search warrant. In Australia, they don’t, so long as the search is lawful.

If police conduct a lawful search, they can seize your camera, SD card, phone, GPS or bike data.

It’s not just the item of the alleged offender; police can also ask a bystander to an offence for evidence.

A lawful search is where you give police permission to search you or when the officer has a “reasonable suspicion” that you could have an item containing evidence of an offence.

How do you not incriminate yourself?

If you don’t want to incriminate yourself, there are some steps you can take.

Without wishing to pervert the course of justice, we suggest you extract the SD card from your camera, bike or GPS.

Or at least turn off your camera to avoid attracting the attention of the police.

If they see the camera or GPS is off or that the SD card is missing, they might assume you weren’t recording.

However, we do not suggest you lie and say you don’t have it or that it wasn’t recording. That could incriminate you in a whole other offence.

In one British case, six riders were banned from driving after two cameras which they had thrown away in a tunnel incriminated them.

Even if you want to use the evidence later in your defence, your lie will then be obvious and police could charge you for providing false information.

If they ask for the camera, GPS, phone, SD card or data logger, you can politely tell the police you will gladly make it available after it has been copied. 

That may not work, unless you have been syrupy sweet.

Don’t be obstinate. That could be seen as refusing to hand over evidence and you could be charged with obstructing a police officer in the execution of their duty.

That would result in a court appearance where you could cop a fine of a few hundred dollars.

The proper procedure is to let them take it and then challenge it in court. But, of course, the horse has already bolted.

Another legal opinion

However, one legal advisor suggests that would offend the right to not incriminate yourself.

“But there is the law and there is reality,” he notes.

“Coppers will usually do whatever is easiest to ‘prove’ an offence. If that entails bullying a motorist into handing over an SD card, that is what the coppers will do.”

If your camera or SD card has been confiscated by the police or handed over to them, ask the officer to make a note of it.

Police must supply you with a receipt of the item as “soon as possible”.

It must also be returned to you in 30 days unless it is to be used as evidence. In that case, police have to apply for an extension through court.

If the matter goes to court, your legal representative can also ask for the card or, at least, a copy to be supplied for your use as evidence.

MBW helping riders seeking justice

The three most popular articles this year have been about riders successfully obtaining justice either in beating incorrect fines or, in once case, getting a driver fined for road rage. In all cases we are happy to say that Motorbike Writer has played a role.

The most popular article was the end result of last year’s most popular article about a driver who put his arm out the window to stop a Newcastle rider legally filtering through traffic.

We published the original article in November 2017 with this video, but police weren’t interested.

But with pressure from the rider and MBW, police eventually fined the driver in January 2018 under Rule 268 (3): Part of body outside vehicle window/door – $325 fine, 3 demerits.

Without the rider’s helmet camera video, the rider might never have won justice.

It is an important example why some state governments should amend laws to allow cameras on helmets.

The second most popular article was about South Australian police dropping a rider’s fine for standing on the footpegs. 

Adelaide rider Tim Byrne says he was fined for standing up while riding through some roadworks in January 2018 despite the practice being legalised in South Australia in 2016 and added to the Australian Road Rules this year.

Tim and Motorbike Writer contacted the police pointing out their error, yet they refused to withdraw the fine.

Motorbike Writer then set Tim up with Maurice Blackburn Lawyers who took on the case a pro bono (free) basis as a “matter of principle”.

As a result, a police supervisor decided to drop the fine.

In the third most popular article, Victorian Police withdrew a fine against a rider for not having an external compliance sticker on his Australian-approved motorcycle helmet.

So we suggested rider Alasdair “Ted” Cameron challenge the $371 fine through Maurice Blackburn Lawyers.

Senior associate Katie Minogue said she was confident her client had a “strong enough case” and was looking forward to their day in court.

However, at the last minute, VicPol have withdrawn the fine.

Once again, this means the issue has not been dealt with in court so no legal precedent has been set.
