Police renew call to identify riders

ACT police have renewed their call for help to identify two riders who were videoed in separate incidents where a car swerved toward them while they were legally lane-filtering.

The incidents occurred on Majura Parkway on Tuesday, October 30. One incident is shown in this video which we published on November 2.

Police were made aware of this video a day later and began investigating.

A second video later emerged showing another rider also being intimidated by the same driver.

This surely demonstrates that the first incident was not accidental. Instead, the driver seems intent on causing alarm and/or injury.

ACT Police made their first call to identify the riders in late November.

It seems the driver cannot be charged without police interviewing the riders.

Police issued these details of the incident:

About 4:30pm, the riders were separately travelling northbound on Majura Parkway, Majura, when a green Ford Falcon swerved, almost colliding with the riders. At the time, the riders were lawfully lane filtering.

Police are also urging anyone who knows the motorbike riders or who witnessed or has dash-cam footage of this incident to contact Crime Stoppers on 1800 333 000, or via the Crime Stoppers ACT website.

ACT Police have confirmed they will alert us on the outcome of their investigation into these incidents.

Legal filtering

Interestingly, these incidents occurred only a few weeks after the ACT made lane filtering legal.

Lane filtering is now legal in all states and territories (except NT and WA which is expected to follow shortly) and has been legal in NSW more than four years.

So there is no excuse for this driver’s ignorance of the laws as the ACT is inside the state of NSW.

Not only is lane filtering legal but it also benefits all motorists as it helps move heavy traffic more quickly.

What does it take for drivers to understand this?

Perth incident

Meanwhile, in another road rage incident in Perth on Sunday, October 28, a driver swerved at a rider twice.

We posted YouTube video of the incidents, but it has since been removed.

However, it showed the driver trying to hit the rider at traffic lights, then a second time further down the road.

At the end of the video the driver gets out at traffic lights to have a go at the rider, but forgets to engage his handbrake! His car almost rolls into the car in front.

We contacted WA Police to make them aware of the video.

They said they would investigate and we have continued to follow up, but they say they are still investigating.

Filtering rage

Drivers trying to obstruct riders has been happening ever since lane filtering was introduced.

Check out this video from last year sent to us by Newcastle rider Harry Criticos.

“I was filtering legally when a driver stuck his whole body out in an attempt to block me,” the 2016 Triple Black R 1200 GS rider told us.

“I did not stop and he did make contact with the bike. I hope it hurt.”

It might be worth telling your driver mates that this particular motorist not only got hit, but also copped a $325 fine and three demerit points.

Lane filtering is legal 

Surely it is time for some major advertising campaigns in each state to advise motorists that riders are allowed to filter and what benefits there are for ALL motorists.

That was the major finding of an online poll we conducted in 2016, yet there are still no major ad campaigns.

So far, lane filtering education campaigns have been minimal and mainly aimed at riders, not the general motoring public.

We are not aware of any polls about lane filtering in Australia.

However, in California where lane splitting (filtering at higher speeds than 30km/h) is legal, polls have found it is vastly unpopular among other road users. The main objection is that it’s unfair!

That breeds hostility which results in stupid behaviour such as in the above video.

So long as lane filtering remains unpopular and/or erroneously believed to be illegal, motorists will do stupid and dangerous things to stop riders filtering.

Police ‘not interested’

Not only are authorities not interested in educating the motoring public about lane filtering, but police don’t seem to help, either.

Police okay Santa novelty helmet covers

If you want to get into the Christmas spirit with a novelty Santa helmet cover, you can be assured the police will not play Scrooge and fine you for a non-compliant helmet.

Motorbike Writer subscriber Travis Yap of Victoria asked us whether a novelty helmet cover would be illegal.

He says he was concerned after reading articles about riders being fined for having painted helmets or attachments such as cameras and Bluetooth units.

Travis bought a Santa Claus cover that simply slips over the helmet and has elastic on the bottom to hold it in place. There are no screws, velcro, glues or other attachments.

We asked the various state police services for their opinion.

VicPol simply replied: “It is not illegal to put a hat over the helmet”.

Queensland and South Australia police agreed that novelty helmet covers are legal but supplied a little more detail:

“Novelty helmet covers are not illegal, as long as the rider is wearing a motorcycle helmet that complies with Australian standards and is securely fastened. Riders will need to ensure that the novelty cover does not obscure their vision.”

We are still awaiting replies from other police services, but don’t expect they will vary from the same theme.

Apart from being fun on many occasions, not just Christmas, novelty helmet covers have some practical advantages.

They protect your helmet from dust, scratches and chips, as well as reducing wind noise.

However, riders should also be aware that there are some disadvantages.

They also reduce ventilation which would make them stiflingly hot on a summer’s day, especially if being worn in a slow-moving toy run procession.

Since they are not securely fastened to the helmet, they can also flap around and shift at high speeds, potentially blocking your vision.

Most suppliers recommend they not be worn on the highway, but only at city speeds.

“I purchased it just for the silly season because it is a bit of fun,” Travis says.

“I expect it will get rather hot under there. I usually just commute to work so maybe I can put up with it for 20 minutes.”

Government blame for motorcycle theft

The former Campbell Newman Government not only disrupted Queensland’s motorcycle industry with discriminatory VLAD laws, but may also have contributed to the state’s skyrocketing motorcycle theft rate.

RACQ spokesman Steve Spalding says the state’s rising car and bike theft rate is a result of the former government’s decision to pull out of the National Motor Vehicle Theft Reduction Council (NMVTRC) about five years ago.

Consequently, Queensland’s motorcycle theft rate has risen the most of any state. In the past 12 months it is up 10.2%, while the national rate is down 3.5%.

“It cost $200,000 a year to be part of the council,” Steve says. “But it gave us access to a lot of research, detailed analysis and effective programs such as the young offender program.”

Police Minister Mark Ryan has not replied to our request for comment about the current government rejoining the NMVTRC.

The massive rise in Queensland’s motorcycle theft rate has prompted a police and RACQ “Stop Stolen Motorcycles” awareness campaign to remind riders to secure their bike.

Theft campaign

In Queensland, the motorcycle theft hotspot is Brisbane where 232 bikes were stolen from 2012 to 2017.

Half were stolen from parking bays, 108 (47%) were taken from a residence and eight (3%) from businesses. 

Only 48% of stolen motorcycles are partially recovered. Most are disassembled and sold for parts.

“The best way to prevent your motorcycle from being stolen is to take significant measures by using anti-theft devices like disc locks with audible alarms or tracking devices,” the Yamaha R1 fanatic says.

“With a loud motion sensor alarm in them they cost from about $50 and act to deter would-be thieves as well as alert the community who are witnesses to the crime.”

Steve, who is a keen Suzuki Bandit rider, says disc locks would make a “relatively inexpensive” Christmas gift for a rider.

The Stop Stolen Motorcycles campaign consists of leaflet drops on bikes and at dealerships, as well as posters at carparks and social media.

The national decrease in motorcycle theft in the past 12 months is a big turn-around.

Motorcycle theft rose 5% in the 2017/2018 financial year while all other vehicle theft across Australia dropped, according to NMVTRC figures.

The biggest change since then has been a marked decrease in theft in Western Australia which had been the worst performing state for some time. In the past 12 months, WA thefts are down a massive 21.3%.

As well as initiatives to make motorcycles safe from theft in Western Australia, the decrease has also been the result of a decline in the state’s economic fortunes since the mining downturn. 

Here’s how you can protect your bike

  • Use a secure disc lock with an alarm and a reminder cord attached to your handlebars so you don’t ride off with it still in place.
  • If you park your motorcycle outside your house, consider installing wireless outdoor security cameras or a motion sensor light near the bike.
  • Also, use the steering lock if your bike has one.
  • Even when parked in a secure location such as your garage or behind a locked gate, consider the extra security of using the steering lock, a disc lock or chain as well.
  • Pull out a spark plug or fuse, or have an immobiliser fitted.
  • Avoid parking your bike in railway or shopping centre car parks as these are notorious for theft.
  • Park in a locked carpark. If you have to park in the open, leave it where you can see your bike or in view of a security camera and/or under a light.
  • Otherwise, keep your bike out of sight, maybe parking it behind your car. If parking in a garage, block the bike with your car and ensure the garage is locked.
  • Use DataDot, DNA+ or a security tag to identify your bike.

  • When riding home, make sure you are not being followed.
  • Stay alert for suspicious vans or trucks driving around late at night. These are used to transport stolen motorcycles.
  • Put a cover over your bike. It might slow down thieves and prevent theft of accessories. But make sure it isn’t a flashy lone with the brand name of the bike on it. That only entices thieves.
  • When riding in a group, park your bikes together.
  • Consider marking your bike in a unique way that could aid in recovery and therefore dissuade thieves.
  • At hotels or public parking spaces, try to park in view of parking lot security cameras and lights.
  • Install a motorcycle alarm and/or a hidden kill switch.
  • Buy a GPS tracking system that can track and relay your bike’s speed, location and direction.

Police launch pilot training course

A police senior sergeant and returned rider, has started a training course for returned riders in his district which he hopes will become a pilot for further courses throughout Queensland.

Snr Sgt Peter Waugh of Jimboomba secured a grant from the Queensland Government’s Community Road Safety Grants scheme for the course. It’s called ‘Mouldy Hogs – Motorcyclists of Jimboomba’ safe ride days.

The first Mouldy Hogs course was held on November 24 at the Mundoolun Community Centre with 12 participants. The second course will be held on December 9.

The pilot courses are run by SMART Rider trainer Steve McDowall with police along for the ride.

Worst rider

“I’m the worst rider in the world,” admits Peter who used to ride a cruiser, but now has a Yamaha Super Tenere.

“I looked at my own situation: I had a bike young, got married didn’t have one for a long time and then came back to it. Sound familiar?

“Bikes have changed in that time and my skills have dulled.”

Peter points to the statistics that show returned riders are over-represented in crash statistics.

“I suppose stats can tell you anything you want. But we are one of the highest fatality injury rates for motorbike riders. So we decided we need to have a look at it and do something,” he says.

“Living and riding in this area we can blame the roads, the conditions, traffic or whatever. We can do that, but the facts are the roads aren’t going to change greatly. If we are on bikes these are the roads we are going to ride.Jimboomba police training course pilot program

“This is what we’ve got to ride on so let’s make it as safe as we can.”

He says the course is not just for returned riders.

“But mainly more mature-aged riders because that’s what the stats are telling us,” he says.

Pilot courses

“We started it down here because these are the roads they will be riding on. It’s their playground.

“But this is not a track day in any shape or form.”

Peter says there is a police presence, but not as official instructors.

“They are along for the ride and will provide feedback and guidance to riders,” he says.

“We are not looking at spoiling their fun or defect their bike, but give them some skills that may help to save their life.”

Jimboomba Police have received funding for 50 riders, but Peter hopes to gain more funding next year and spread the course statewide.

Cops withdraw Lidar speed gun fines

South Australia Police is temporarily suspending use of the Lidar speed gun and withdrawing 150 speeding fines after three court decisions found police can misuse the handheld guns.

The three defendants charged with speeding detected by police on Lidar guns had their fines overturned.

Now, SAPOL is temporarily withdrawing Lidar guns until legislation is amended to resolve the legal issues with regard to the evidentiary certificates.

They are also withdrawing 125 speeding fine prosecutions.

South Australian Ride to Review spokesman Tim Kelly says anyone who copped a Lidar speed fine and has not yet paid should apply for a review.

Impact for other states?

While the judgments were delivered in the South Australian Supreme Court, they could have an impact for all states and territories if the calibration of the guns is questioned.

However, there is no movement yet by other states to withdraw Lidar guns.

The three decisions were all based on an argument put forward by lawyer Karen Stanley of Stanley Law. Her full statement on the judgments is included in full at the end of this article.

The judgments are based on a previous case run by Ms Stanley in 2016 case where speeding charges were thrown out because of the police calibration methods for the LIDAR hand-held speed gun. In one of the three recent cases, a motorcyclist was recorded riding 126km/h in a 60 zone in Adelaide.

“My attack was to the certificates that prosecution uses to prove that the guns were accurate,” Karen says.

She points out that the Lidar guns are not necessarily inaccurate or unreliable, but that the police method of calibration, and the way police certify their accuracy, is at fault.

Whether the judgments will apply across all states and territories will depend on the wording of the certificates and what the law says, she says.

“However, I expect that the broad principles His Honour addressed in the substantive case of Police v Hanton, will apply in all states,” she says.

Justice David Peek criticised South Australian Police for failing to change their testing system since the 2016 verdict.

He wrote that police appeared willing to “accept the odd setback in terms of a not-guilty trial because the cost of that is less than fixing the system”.

There is no word yet from government on changes to legislation to allow police to start using the guns again.

Meanwhile, SAPOL say they will continue to use other “well-established speed detection options” such as hand-held radar devices and fixed and mobile speed cameras.LIDAR radar speed gun

Stanley Law statement regarding South Australian Supreme Court Judgments

On Thursday 19 July 2018, the South Australian Supreme Court published three significant judgments about the use of hand held LIDAR speed guns to detect vehicle speeds. These cases all relied on the argument successfully raised in Police v Butcher, a 2016 Supreme Court decision that resulted in speeding charges against the defendant being dismissed. While the individual cases are complex, the unifying issue in each was the reliance by prosecution on a certificate to prove the accuracy of the speed guns used to detect the speed of the defendants’ vehicles. Justice Peek found that the certificate relied on by the prosecution was not capable of proving the accuracy of the speed gun to within the margin of error stated in the certificate.

To be clear; the Supreme Court did not say that the speed guns were inaccurate. Rather, the Court found that prosecution could not prove that the devices were accurate by relying on the certificate. Speculation on social media that the judgments have “proved” that speed guns are inaccurate and unreliable, is incorrect.

There is always a presumption of innocence and prosecution must prove, beyond reasonable doubt, that the offence was committed. One of the things that prosecution need to prove for speeding charges is that the device used to detect the vehicle is accurate. It would be cost prohibitive for prosecution to prove the technology behind the speed devices in every case. This would require experts to give evidence at every trial on how the devices work. To simplify this, the law in Australia allows the prosecution to rely on certificates, signed by a senior police officer, that certify the accuracy of the speed gun used. That certificate then becomes proof of the accuracy of the speed gun and the onus then switches to the defendant to provide “proof to the contrary” of what is certified.

While it may appear that this shifting of the evidentiary burden means that in speeding cases the defendant has to prove that they are not guilty, in actual fact, this only occurs once prosecution have proved that the device is accurate. It’s the certificate that prosecution relies on to prove this. The burden of proof only switches to the defendant once there is proof of the accuracy of the device.

The argument in the 2016 case, and in each of the three judgments handed down last week, was that the prosecution could not rely on the certificate because prosecution could not prove that the gun was accurate to the extent certified in the certificate, ie, within a margin of +2/-3kph. Without the certificate, there was no evidence of the accuracy of the device and therefore prosecution could not prove the speed of the vehicle. This is why the alleged speed of the defendant was irrelevant. Speed guns are required to be calibrated every 12 months in accordance with the Australian Standards. This involves an extensive process of testing the gun in a simulator. When a speed gun is calibrated, a report is issued which states that the gun is accurate to within a specific margin of error.

In addition, police are required to perform a number of daily tests, as prescribed by the manufacturer. These tests are recorded as pass/fail. The law requires that these tests are performed on the day that the device is used. The results of these tests are then used when producing the certificate.

In each of judgments published in July 2018 Justice Peek held that prosecution could not rely on the certificate because the daily testing by police doesn’t show that the devices are accurate to within +2/-3kph. The finding in each of these cases is the defendant did not need to prove that the device was inaccurate, but only that the daily testing done by police didn’t prove that the device was accurate to the extent claimed in the certificate. Without the certificate the prosecution was unable to prove the speed of the vehicles.

In addition, Justice Peek made a number of criticisms of the current testing regime of speed detection devices, and the circumstances under which the certificates are issued. Justice Peek further expressed concern that despite warnings in 2016 (Butcher) and 2017 (Henderson), the prosecution of speeding charges has continued without addressing the issues raised in the earlier cases.

SAPOL has issued a statement confirming that they are assessing the judgments “to fully comprehend if changes need to occur”. These judgments make it abundantly clear that changes need to occur. While SAPOL and prosecution continue to prosecute speeding charges in the manner they have to date, defendants will continue to have speeding charges dismissed. The argument first raised in Police v Butcher is clearly not a “one-off” as stated at the time.

The judgments handed down last week are lengthy and complex and will require further analysis in order to determine what ramifications these judgments have beyond the individual cases, although it is already clear that the broader implications are significant.

There is some commentary on social media about what impact these judgments will have on expiation notices issued since SAPOL was first put on notice about problems with relying on the certificates. At this stage it is too early to speculate on this.

Video shows hi-vis does not work – even for cops!

This British video of a police officer with sirens going and a hi-vis jacket and bike shows that some motorists still don’t see riders.

It shows a police special escort group of BMW R 1200 bikes escorting British Prime Minister Theresa May with the Metropolitan Police’s Protection Command in London.

Right from the start it shows a van driver doesn’t even see the police officer with hi-vis gear, flashing lights and sirens.

This video comes as a Monash University report into motorcycle accidents suggest riders and bikes be more visible.

The report, quaintly titled “Current Trends in Motorcycle-Related Crash and Injury Risk in Australia by Motorcycle Type and Attributes” suggests promoting high-visibility motorcycle clothing and research into its effects.

It also suggest increasing motorcycle visibility technology such as modulating headlights.

If even bike cops officers can’t be seen, what more could we riders possibly do to be seen and heard on the road?

Most riders resist mandatory hi-vis gear as is required for Victorian novice riders and France where riders have to carry a hi-vis vest to wear the vest during a breakdown.

Many claim they are still not seen even when wearing bright gear and on brightly coloured motorcycles.

While Monash Uni suggests hi-vis Prof Richard Huggins of University of Melbourne says there is no research that proves hi-vis vests aid safety.

Richard says he has studied many scientific studies about hi-vis clothing and says there is no conclusive evidence it is safer for riders.

However, there are several international studies with varied findings suggesting:

  • Dark clothing is more visible in certain lighting situations;
  • Hi-vis rider gear may be less visible in certain conditions; and
  • Hi-vis clothing could create a “target fixation” for motorists, causing them to steer toward the wearer.

Richard also says he regularly wears a hi-visibility jacket when riding, but has still been hit by a car.

“The driver claimed they didn’t see me, from a distance of less than 2m, as they changed lanes on top of me,” he says.Hi-vis vest

The Victorian Motorcycle Council also says hi-vis is a safety myth, claiming:

  • Modern research shows that people don’t recognise or react to motorcycles, rather than not seeing them at all;
  • Drivers are more likely to see a bike but make an error in timing; and
  • All bikes have hard-wired headlights yet no research has been done on how this affects hi-visibility.

Some say group rides with lead and tail-end riders in hi-vis vests destroys our argument.

However hi-vis vests on group rides are not worn for safety reasons. They are there to help distinguish those riders from the others so that riders don’t accidentally pass the lead rider or fall behind the sweep.

Rider loses helmet strap fine challenge

A Perth rider has failed in his challenge to a $550 fine for a loose helmet strap after he says he only loosened it with one hand to talk to two motorcycle police who pulled him over.

Julian Collis says the judge sided with the officers despite proving in court he could undo his helmet with one hand and despite both cops swearing he was wearing an open-face helmet.

“I had taken my motorcycle gloves off and put them on the console and loosened my chin strap to take off my helmet but I kept it on when I was told I wasn’t being done for speeding.”

Reasonable doubt

Julian also believes his lawyer proved there was reasonable doubt that police missed seeing him loosen his helmet strap as they were occupied issuing a speeding ticket to a driver at the time.

Unfortunately the police officers’ helmet cameras were not operating as they had parked their bikes to conduct the speed trap.

“In the end, the judge said the two officers had dovetail evidence,” he says.

“We pointed out that they had lunch together in the court recess and could have illegally collaborated on evidence.

“The judge asked if they discussed the case and they said they didn’t and the judge believed them.

“It was a case of two against one.”

Court costs

Julian copped the original $550 fine and four demerit points plus $205 court costs, although his lawyer did not charge him a fee.

However, he says he has no regrets.

“I got to say my piece and tell the truth from what I can remember on the day,” he says.

“I wouldn’t ride around with a loose helmet strap. I value my safety as I have three small children at home and I’ve been riding for 20 years.  

“I could appeal to the Supreme Court, but my lawyer said we had done as much as we can.”

Regulation 244 of the Western Australia Road Traffic Code 2000 states that a motorcycle must not be ridden unless an approved helmet is securely fitted and fastened to the head of the rider. 

“It doesn’t mention anything about how tight the helmet strap should be so it’s open to police interpretation,” Julian says.

Police seek riders in lane filtering incidents

ACT police have asked for help to identify two riders who were videoed in separate incidents where a car swerved toward them while they were legally lane-filtering.

The incidents occurred on Majura Parkway on Tuesday, October 30. One incident is shown in this video which we published on November 2.

Police were made aware of this video a day later and began investigating.

Two incidents

It now appears there were two incidents involving the same driver.

This surely demonstrates that the first incident was not accidental. Instead, the driver seems intent on causing alarm and/or injury.

ACT Police have now released the images on this page (at top and below) of both incidents.

They are seeking the identity of the two motorbike riders involved and have released this statement:

About 4:30pm, the riders were separately travelling northbound on Majura Parkway, Majura, when a green Ford Falcon swerved, almost colliding with the riders. At the time, the riders were lawfully lane filtering.

If you are one of the motorbike riders affected please contact ACT Policing on 131444. Please quote reference 6327970.

Police are also urging anyone who knows the motorbike riders or who witnessed or has dash-cam footage of this incident to contact Crime Stoppers on 1800 333 000, or via the Crime Stoppers ACT website.

ACT Police have confirmed they will alert us on the outcome of their investigation into these incidents.

Legal filtering

Interestingly, these incidents occurred only a few weeks after the ACT made lane filtering legal.

Lane filtering is now legal in all states and territories (except NT and WA which is expected to follow shortly) and has been legal in NSW more than four years.

So there is no excuse for this driver’s behaviour in the ACT which is inside the state of NSW.

Not only is lane filtering legal but it also benefits all motorists as it helps move heavy traffic more quickly.

Perth incident

Meanwhile, in another road rage incident in Perth on Sunday, October 28, a driver swerved at a rider twice.

We posted YouTube video of the incidents, but it has since been removed.

However, it showed the driver trying to hit the rider at traffic lights, then a second time further down the road.

At the end of the video the driver gets out at traffic lights to have a go at the rider, but forgets to engage his handbrake! His car almost rolls into the car in front.

We contacted WA Police to make them aware of the video.

They said they would investigate and when we followed up yesterday they said they were still investigating.

Filtering rage

Drivers trying to obstruct riders has been happening ever since lane filtering was introduced.

Check out this video from last year sent to us by Newcastle rider Harry Criticos.

“I was filtering legally when a driver stuck his whole body out in an attempt to block me,” the 2016 Triple Black R 1200 GS rider told us.

“I did not stop and he did make contact with the bike. I hope it hurt.”

It might be worth telling your driver mates that this particular motorist not only got hit, but also copped a $325 fine and three demerit points.

Lane filtering is legal 

Surely it is time for some major advertising campaigns in each state to advise motorists that riders are allowed to filter and what benefits there are for ALL motorists.

That was the major finding of an online poll we conducted in 2016, yet there are still no major ad campaigns.

So far, lane filtering education campaigns have been minimal and mainly aimed at riders, not the general motoring public.

We not only need major ad campaigns, but also roadside signage such as this photoshopped sign.

We are not aware of any polls about lane filtering in Australia.

However, in California where lane splitting (filtering at higher speeds than 30km/h) is legal, polls have found it is vastly unpopular among other road users. The main objection is that it’s unfair!

That breeds hostility which results in stupid behaviour such as in the above video.

So long as lane filtering remains unpopular and/or erroneously believed to be illegal, motorists will do stupid and dangerous things to stop riders filtering.

Police ‘not interested’

Not only are authorities not interested in educating the motoring public about lane filtering, but police don’t seem to help, either.

Eventually the driver was charged.

Witnesses sought for car hitting Harley

Witnesses are being sought after a 2004 blue Honda Accord sedan merged into a lane with a 2012 blue Harley-Davidson causing it to crash on the Logan Motorway at Springwood last Wednesday (November 7, 2018).

Forensic Crash Unit investigators have released this video as part of an appeal for information.

The crash happened about 4.50pm on the Logan Road on-ramp, towards the southbound lanes of the Pacific Motorway.

A 55-year-old Harley rider was hit when the Accord to merged into his lane. He remains in the Princess Alexandra Hospital in a serious but stable condition.

A 21-year-old Woodridge man “continues to assist with the investigation”.

The driver did not pull up after the Harley crashed at the side of the road.

However, a second motorcyclist pulled the driver over for a short conversation before riding on.

Police now want to speak with the second motorcyclist to continue investigations into the crash, or any other witnesses, particularly those with dash cam footage.

Motorcycle helmet sticker fine withdrawn

Victorian Police have withdrawn a fine against a rider for not having an external compliance sticker on his Australian-approved motorcycle helmet.

But don’t get too excited just yet that VicPol has seen the light and understands the rules which say a helmet only needs an internal label.

Rider Alasdair “Ted” Cameron challenged the $371 fine and took the issue to Maurice Blackburn Lawyers.

Senior associate Katie Minogue said she was confident her client had a “strong enough case” and was looking forward to their day in court.

However, at the last minute, VicPol have withdrawn the fine.

That means the issue has not been dealt with in court so no legal precedent has been set.

Police harassment

So police are still at liberty to use their erroneous reading of the rules to issue fines and harass riders.

Ted says he felt harassed as soon as he was pulled over in April 2018 on his 2016 Harley-Davidson Dyna Low Rider S about 200m from his Geelong home by one of two police officers patrolling on dirt bikes.

“I hadn’t done anything wrong, so I asked, ‘what’s up?’.

“The cop says ‘you’re riding a motorcycle in Victoria’, so I knew this guy was not up for a chat!”

The officer then told him his helmet was not compliant because it did not have a sticker on the outside.

“I just agreed with him and didn’t enter into much conversation or argue with him,” Ted says.

While Ted politely accepted the ticket without argument, he decided he wanted his day in court.

Fine withdrawn

However, he has now received a phone call to say the matter has been dropped because it was “trivial”.

“The copper that picked me up rang and I didn’t answer as it was a private number, so he left a message saying who it was from the Solo Unit,” Ted says.

“He said something like ‘the matter has been not authorised, it will just disappear, you do not have to do anything, it was just being trivial’.

“He was clearing his throat a couple of times so he must have been struggling to say it.

“That message just threw me.”

Ted contacted his lawyers who have contacted police to ask for the official notice of the withdrawal.

“I feel a bit better now and want to thank you (Motorbike Writer), Guy (Motorcycle Council of NSW helmet law expert Guy Stanford) and the lawyers for everything you’ve done to help me,” Ted says.

“But I wanted my day in court. It would have been good to really stick it up them.”

While there is still no legal precedent, Guy Stanford advises that there is no need for an external sticker so long as there is an internal sticker or label.

It doesn’t matter if the label has faded with wear.

Ted says his internal label was difficult to find, but was shown to the officer who still issued him the fine.

Katie says the Victorian Road Rules state that an approved helmet must be marked with the official standards mark.

“It does not specify where this mark needs to be,” she says.

“We say there is no obligation in the rules that the sticker needs to be on the outside of a helmet.”
