Two charged after stolen bike crash

Two men riding a stolen motorcycle and not wearing helmets have been arrested and charged after a police pursuit on the NSW Central Coast today (31 May 2020).

Just after 10.30am, a motorcycle, allegedly stolen from an Erina shopping centre, was seen travelling on Hely Street at Wyong.

At the time, the rider and pillion passenger were not wearing helmets.

Officers from NSW Police Brisbane Water Police Area Command attempted to stop the motorcycle on Enterprise Drive.

When it allegedly failed to stop, a pursuit was initiated before being terminated shortly after due to safety concerns.

Stolen bike

The stolen motorcycle continued through the Central Coast area and was monitored by PolAir.

At the intersection of Erina Street and Henry Parry Drive, Gosford, the rider and another vehicle crashed.

The rider and passenger were thrown from the motorcycle and fled.

Shortly after, a 30-year-old man was arrested nearby.

The second man ran to the rooftop car park of a nearby abandoned shopping centre. Police followed on foot, before the man jumped a barrier, landing on a window ledge below.

With the assistance from Fire & Rescue NSW, Police Rescue and other specialist resources, the 23-year-old man was rescued and arrested.

Both men were taken to Gosford Hospital, under police guard, suffering injuries sustained in the crash.

The younger man has been charged with:

  • Larceny (two counts);
  • Shoplifting;
  • Take and drive conveyance;
  • Police pursuit – not stop – drive recklessly;
  • Drive recklessly/furiously or speed manner dangerous;
  • Unlicensed rider; and
  • Rider without helmet with passenger.

He has also been charged with a revocation warrant.

The older man has been charged with:

  • Motorbike passenger no helmet;
  • Be carried in conveyance;
  • Possess a prohibited drug (two counts); and
  • Breach of bail.

They have been bail refused to appear in Newcastle Local Court on Monday (1 June 2020).

Riders charged after two police pursuits

Two motorcyclists riding at speeds up to 200km/h have been charged following two separate pursuits with NSW Police in Sydney’s south west.

This is the type of stupid behaviour that brings all riders into disrepute.

It may also delay an easing of pandemic travel restrictions as Queensland plans to do from next Saturday.

Officers from Bankstown Traffic and Highway Patrol – with the assistance of South West Metropolitan Region Enforcement Squad (RES), the Dog Unit, and PolAir – conducted Operation Bluey on Friday (24 April 2020) and Saturday (25 April 2020), targeting high performance motorcycles engaged in dangerous riding practices and pursuits with police.

Pursuit 1

About 8.20pm on Friday (24 April 2020), officers were stopped on Rawson Road, Greenacre, when they saw a BMW s1000 RR travelling on Rawson Road before crossing to the incorrect side of the road and turning right into Waterloo Road, disobeying a red traffic light.

A pursuit was not initiated and despite patrols, the motorcycle could not be located.

A short time later, the motorcycle was seen travelling on Juno Parade before allegedly speeding away at no less than 100km/h before crossing to the incorrect side of the road and turning left into Nobel Avenue.

Further police allegedly sighted the motorcycle turn left into Mimosa Road and allegedly speed away at no less than 120km/h in a signposted 50km/h zone.

With the assistance of PolAir, the motorcycle was monitored as it travelled to a home on Wangee Road, where it was ridden through the front door and parked in the lounge room.

Shortly after, officers entered the home and the rider, a 24-year-old man, was arrested.

He was charged with motor vehicle exceed speed more than 45km/h – estimated, drive recklessly/furiously or speed/manner dangerous, and vehicle number plate not correctly fixed.

The man is due to appear at Bankstown Local Court on Wednesday 29 July 2020.

Pursuit 2

About 11pm yesterday (25 April 2020), officers patrolling King Georges Road, Wiley Park, saw a Suzuki GSX-R1000 motorcycle, carrying a pillion passenger. The rear number plate was obscured.

With the assistance of PolAir, the motorcycle was monitored. Officers attempted to stop it nearby on Canterbury Road; however, it failed to stop and allegedly sped away at 160km/h in a signposted 60km/h zone.

A pursuit was initiated before being terminated shortly after due to safety concerns.

The motorcycle was again seen travelling on King Georges Road, riding only on its back wheel before allegedly speeding away at least 200km/h.

PolAir continued to monitor the motorcycle as it travelled to Greenacre, where the pillion passenger got off.

Shortly after, officers attended a nearby home and located the rider, who was the holder of a P1 licence and disqualified from driving until 2032.

The 23-year-old man was arrested and taken to Bankstown Police Station where he was charged with police pursuit – not stop – drive dangerously, drive recklessly/furiously or speed/manner dangerous, drive during disqualification period, and vehicle number plate obscured.

He was refused bail to appear at Parramatta Bail Court today (Sunday 26 April 2020).

Rider dies after evading police pursuit

A male rider has died in a crash with a pole after NSW police abandoned a pursuit in Newcastle overnight for safety reasons.

Presumably the motorcycle reached high speed, forcing police to terminate the pursuit. Click here to read more about police pursuit procedures.

NSW police have launched a critical incident investigation.

They say officers were patrolling the CBD about 3am today (8 January 2020) when they attempted to stop a motorcycle on Hunter St, near Steel St.Pursuit

“A pursuit was initiated after the motorcycle allegedly failed to stop, before being terminated shortly after due to safety concerns,” the police say.

They would not comment further on the speeds as the incident is subject to investigations.

“The motorcycle continued to travel along Hunter Street before being found crashed on Scott Street, after hitting a pole,” police say.

“Officers rendered first aid; however, the male rider died at the scene. He is yet to be formally identified.”

Specialist forensic officers created a crime scene, closing off Scott Street remains between Wolf and Watt Streets.

A critical incident team from Port Stephens-Hunter Police District is investigating the incident.

Their investigation will be subject to an independent review with information provided to the Coroner.

Fleeing motorcycle rider crashes and dies

A 35-year-old motorcycle rider who failed to stop for Queensland Police at Northgate in Brisbane yesterday (11 December 2019) was later killed in a crash with a 4WD.

Queensland Police say they did not pursue the motorcycle after they tried to intercept it about 4.50pm  on Peary Road.

“A short time later the police vehicle located a two-vehicle crash involving the motorcycle and a 4WD at the intersection of Peary Road and Northgate Road,” police media say.

“The motorcycle rider, a 35-year-old Wakerley man was pronounced deceased at the scene.

“The driver and sole occupant of the 4WD, a 60-year-old woman from Wavell Heights was not injured.”

The Forensic Crash Unit and Ethical Standards Command are investigating.

Police have appealed for anyone who witnessed the crash or motorists with dashcam vision to contact them on Policelink, 131 444, an online form or anonymously on Crime Stoppers 24 hounds a day.

While not making any judgements on this case, motorcycle riders typically fail to stop because they are unlicensed, drunk, are close to losing their licence or the vehicle is stolen.

Police in most states do not pursue vehicles in such cases.

A leading police study has found the three most pressing issues for police reform around the world are use of force, policing of violence in families and high-speed pursuits.

A 2009 Australian Institute of Criminology study found deaths in custody at police stations are declining but “deaths in custody” as a result of high-speed pursuits were rising.

While less than 1% of police pursuits results in a fatal crash, 38% of the people killed are innocent bystanders.

It’s much worse in the USA where one person dies every day as a result of a police pursuit. Of those deaths, 1% are police, 55% suspects and 44% bystanders.

Most police procedures acknowledge the judgement of the officer at the scene to begin a pursuit.

However, continuation of the pursuit is then deferred to a senior officer at the station or headquarters.

They have to make a quick judgement based on the lethal risk to the community of the chase versus the lethal risk to the community of letting a serious offender escape.

This must be backed by information, not just mere suspicion.

Queensland police figures show only about 3% of pursuits involved imminent threat to life or a suspect escaping after a homicide.

Police have a duty to not only prevent and control crime, but more importantly, they have a duty to protect the community and that includes from their own reckless behaviour and judgement.

Perth rider killed after police pursuit

A 24-year-old Perth rider has died after a woman who had been involved in a police pursuit crashed into him early Thursday morning on the wrong side of the road.

Jordan Thorsager was riding his Kawasaki on the Leach highway just after midnight when he was hit head-on by the driver.

Police say they were not pursuing the woman at the time of the crash, but confirm they had been chasing her “on and off” over the previous hour. She was wanted on an arrest warrant.

Western Australia Police Major Crash investigators and police Internal Affairs officers are investigating the pursuit and are calling for witnesses.

Surprisingly, his family is willing to forgive the driver and does not question police conduct.

Restrictive practices

Despite criticism from police unions, most pursuit policies around the world, including the USA, are becoming more restrictive.

In many jurisdictions, pursuits are only allowed if there is a serious risk to public safety or in relation to a major crime involving death or injury.

However, there is an issue about making these pursuit policies public. Some say they should be public to show transparency while others believe it would give criminals clues on how to evade police.

Those who support pursuits point out that the number of people evading police is rising as a result of more restrictive pursuit policies, despite higher penalties for evading police.

Making the issue more complex is the degree of the pursuit.

Should there be an upper speed limit for police? Should police be allowed to break other road rules in the pursuit?

There have been incidences of police driving at more than 200km/h in a pursuit and on the road side of a major highway.

Another issue is whether police should be criminally culpable in the instance of a death resulting from a pursuit.

To a degree, technologies such as CTV and automatic number plate recognition (ANPR) devices, negate the need for pursuits.

WA police have ANPR, but it is not known whether it was available in the pursuit patrol vehicle.

In some cases, APNR may actually trigger a police pursuit.

VicPol gets number plate recognition

Victoria Police have enlisted their first patrol car with automatic number plate recognition technology, lagging behind other states.

The technology, developed by Motorola Solutions Australia, is helpful for riders as it will reduce the need for police to pull riders over for licence checks or for dangerous high-speed pursuits.

It will also help police catch those unlicensed riders on stolen and unregistered bikes who crash and adversely affect the road toll statistics for riders.

We couldn’t get quick access to statistics of illegal riding and subsequent crashes.

However, as an example, Queensland Main Roads says more than 5700 infringement notices were issued from 2015 to the end of October last year for riding an unregistered motorcycle or unlicensed riding.

A few years ago VicPol noted that illegal riders represented a third of all fatal motorcycle crashes.

They couldn’t provide a current breakdown for motorcycles, but did provide these sobering crash stats from 2016:

  • Unauthorised drivers were at fault in 16% of all crashes; and
  • One in five injury collisions involving an unregistered vehicle also involved an unauthorised driver/rider.

The first VicPol patrol car with the recognition technology will be deployed in Bendigo with 220 more to be rolled out across the state over the next two years.

The system will allow police to scan about 5000 number plates per shift. Their vehicles will also be fitted with video cameras for evidence.

However, VicPol is playing a game of catch-up with other states.

NSW Police say all marked Highway Patrol Vehicles and selected general duty vehicles already carry automatic number plate recognition technology.

“Those that ride unregistered motorcycles, or ride unlicensed, continue to put themselves and other road users at great risk,” they told us.

Queensland has 77 police cars and motorbikes with the tech with more due before the middle of the year.

South Australian Police acknowledge they have them but were coy, as usual: “We wouldn’t provide the number of cars with ANPR cameras as we don’t generally discuss our resources.”

But we’re glad they have them!
