Call for Ebikes to be registered

Ebikes or pedal-assisted electric bicycles are growing out of control in many countries, creating danger for other road users, robbing motorcyclists of parking and giving all riders a bad name.

There are now calls in Australia and around the world for regulation or registration for these vehicles.

In China it is so bad, more than 10 major cities have restricted or banned them, despite the bikes providing cheap and easy transport.

Many see them as a green transport alternative that free up the city and provide cheap transportation with some health benefits.

However, some Chinese authorities claim ebikes are dominating bike lanes, endangering bicycle, motorcycle and scooter riders as well as other motorists. They are also riding on footpaths and paying little attention to road rules.

Many other countries are now finding similar problems with the burgeoning growth of ebikes and the EU has complained about China dumping bikes in Europe.

There is a fear that they will grow even faster in the post-pandemic world where people eschew public transport because of the dangers of infection.

Motorcycle manufacturers such as Ducati and even Harley-Davidson are getting into the ebikes trend.

Like many countries including Australia, you can ride an ebike without a licence.

In Australia, they are limited to 25km/h, but illegal and virtually untraceable modifications can make them such faster and more dangerous.

Ebikes menace

Long-time motorcycle advocate Rodney Brown says they are a menace.

“Ebikes are unregistered, the riders unlicensed, some not roadworthy, uninsured and electrical grid drainers,” he says. 

“They need to be registered, insured, roadworthy, speed restricted, age restricted and need to heavily enforced.”

He says they are also taking up valuable footpath parking space in Melbourne.

This follows calls last year by the the Tasmanian Motorcycle Council for free identification numbers, not registration, for cyclists over 18 so their traffic offences can be reported and riders fined.

Their call was backed by Emeritus Professor of Transport Marcus Wigan who says electric bicycles and scooters blur the lines between bicycles and registered motorcycles and scooters.

He says bicycles are legal transport and as such should be bound by the same features of ID as other vehicles using the roads.

Delivery riders flouting road rules

Some motorcycle, scooter and bicycle delivery riders are flouting traffic and parking rules, endangering pedestrians and other road users, says Motorcycle Council of NSW vice-chairman Jason Antony.

He says it has worsened under the current pandemic lockdown, as more and more people use online services to order meals.

“The food delivery industry — part of the burgeoning gig economy — is in dire need of regulatory oversight as well as scrutiny from road safety authorities,” Jason says.

“As a significant number of these workers are from overseas, it would not surprise me if they do not hold an Australian licence.

“Many such riders therefore tend to be unfamiliar with, or have little regard for, Australia’s traffic system and road rules — often endangering other road users, including pedestrians, for very little gain.

“For years, I have observed them on barely roadworthy motorbikes and scooters, choosing to behave in an increasingly dangerous manner as they stare at their mobiles, focussing on text and video conversations instead of their surroundings.

“Even L-platers can be frequently seen lane filtering, lane splitting, kerb filtering, failing to give way, chucking U-turns into the path of oncoming traffic, running red lights, almost striking pedestrians who are crossing legally … the list goes on.”

Under lane filtering rules, only those who hold a full Australian motorcycle licence are permitted to lane filter, not overseas licence holders.

We asked Brisbane, Sydney and Melbourne councils if they had an issue with scooter delivery riders and whether they were over-represented in traffic and parking fines. However, they said they didn’t keep records relating to delivery riders. They also didn’t have any specific operations to keep a check on them.

Jason says the perceived lack of targeted action by the relevant authorities to hold errant delivery riders to account is perplexing.

“Over the past few years, I have observed an increase in the number of delivery riders taking more risks, breaking more road rules and creating close calls — yet we have not seen a campaign targeting them,” he says.

“The message needs to be spelled out and enforced with no wiggle room: inconsiderate, reckless and dangerous riding that puts others at needless risk will not be tolerated.”

Jason says it’s not just motorcycle and scooter delivery riders at fault.

He says many push-bike delivery riders are also illegally riding on footpaths, including many on power-assisted electric bikes despite the roads being relatively empty during the lockdown.

“They power through narrow footpaths at ridiculous speeds, speed past shop entrances and intersections, bang the bell when approaching pedestrians and frighten them out of their way — others silently scrape past those on foot with very little room to spare.”

In some states, it is illegal to ride a bicycle on pedestrian footpaths, but there are some exceptions for children.

Licensing and training

Jason says all delivery riders should be made to undertake road rules training and a defensive riding course.

“It could provide the impetus for food delivery riders to understand the responsibilities that come with operating a vehicle on the roads safely, sensibly and considerately,” he says.

“At the end of the day, it is about their safety as well — not merely the general public’s.”

He also points out that people with overseas driver/rider licences must obtain a relevant local licence after a certain period, usually three months.

Jason says this should be rigidly enforced.

Are motorcycle licence trainers up to the job?

Since novice motorcyclists have one of the high rates of fatal crashes, have you ever wondered if rider trainers are teaching the right methods?

Last year, the UK struck off 100 motorcycle licence trainers and 18 training companies for a range of offences including granting licences without any training.

Other non-compliance issues were having too many students in a class, granting licences after less than three hours of training and using non-roadworthy motorcycles.

The breaches were uncovered in annual audit checks of licences trainers and facilities.

Aussie trainers

So we contacted the relevant departments in each state of Australia to find out if there were similar quality audits and any breaches.

However, only the Queensland and NSW transport departments bothered to reply after more than a week.

In October 2016, Queensland Transport and Main Roads introduced the standardised Q-Ride training curriculum and upgraded audit and monitoring program.

The following month, two QRide instructors were arrested for issuing motorcycle licences and 13 falsely licensed riders.

For the next two years, TMR conducted training and support for the industry before introducing compliance auditing in October 2018.

Up to the end of last year, TMR conducted 47 full compliance audits of rider learning facilities and has not cancelled any of the 85 accredited QRide trainers or 35 service providers.

We use a range of investigative methods and compliance tools, including education, suspension and issuing corrective actions,” a TMR spokesperson says.

Transport for NSW accredits five Registered Training Organisations (RTO) across the state and monitors the safety of operations, staff professionalism, compliance with road law and processes around misconduct. 

TNSW has so far carried out 18 quality assurance checks this financial year.

They did not say if there were any breaches, but 18 checks on five facilities seems rigorous.

“Continuous improvement and professional development is provided during the sector’s mandatory annual forum,” a spokesperson says.

Reader comments on this website and our social media pages seem to suggest that novice riders are not getting the right training.

However, statistics show that over the past 25 years, as rider training has become more regulated and licensing more difficult, fatality rates for novices have actually reduced.

While still high, riders under 30 have been surpassed in recent years by those aged over 50, mainly due tothe rapid rise in “returning riders”.

Minimum rider age limit increased

The minimum rider age for South Australians will be raised by two years with some concessions, but they have dodged a plan for mandatory hi-vis vests as in Victoria.

Around the nation it is getting tougher and tougher for young people to get motorcycle licences with Queensland even requiring them to first hold a car licence for a year.

The Australian trend to make it more difficult for younger riders runs contrary to Europe.

In Germany, the minimum rider age has recently been lowered from 16 to 15 while the moped and restricted motorcycle licence (up to 125cc) minimum age in Latvia and Estonia is 14; 15 in France, Czech Republic, Spain; and 16 in Portugal, Romania.

These countries believe that getting teenagers on to motorcycles teaches them a sense of vulnerability and roadcraft before they are let loose on larger bikes or cars.

SA Police Minister Corey Wingard said they would introduce the new bill on graduated motorcycle licensing in the next few months.

Minimum age

The Minister said that last year there were 17 fatal motorcycle crashes in SA with 11 aged under 31 while the youngest was 16.

How does increasing the minimum age have anything to do with those figures, except for maybe that one fatality?

He also says that between 2014-18 young motorcycle riders were over-represented in serious crash data with 10% involving riders aged 15-19, 11% involving riders aged 20-24 and 10% riders 25-29.

So those over 29 represented 69% of serious crashes!

In fact, national statistics from 1995 to 2019 show a steady decrease in fatalities among under 30-year-old riders from 562 in the five-year period from 1995 to ’99 to 312 from 2015 to ’19.

Over the past five years, under 30s have not had the largest number of fatalities, being overtaken for the first time by over 50s with 323 deaths.

This could be the result of tougher licensing laws.

However, it could also be due to the fact that the number of young riders getting licenses has declined while the number of returned riders has increased.

The statistical trends are similar in all states including Queensland and South Australia where under-30s fatalities have halved since 1995.

New rules

The new SA rules will allow various exclusions for students, workers and regional residents.

For example, regional resident aged 16 and 17 can get a restricted motorcycle learner’s permit to travel to tertiary education, vocational education and training or for work.

Also 17-year-olds with a current provisional car licence can get a motorcycle learner’s permit.

There will also be a night curfew on under 25s from midnight to 5am unless the rider has an exemption which is in line with current rules for p-plate drivers.

Spokesman Tim Kelly says they worked hard with the government to secure the concessions and to avoid the planned mandatory hi-vests.

Full details of the new Bill have not yet been released, but previous recommendations included: displaying correct plates, restricting pillions, mandatory carriage of licence, zero blood alcohol, a lower demerit point threshold for disqualification and no mobile phones.

Federal Chamber of Automotive Industries (FCAI) motorcycle spokesman Rhys Griffiths says tougher licensing laws across the nation have put the motorcycle industry under “more pressure than we’ve ever had in the past”.

He says the tougher licensing laws have dramatically increased the price of obtaining a motorcycle licence and may have led to an increase in unlicensed riding.

Should drivers ride light motorcycles?

A new survey has found a large majority of European riders believe drivers should be allowed to ride light motorcycles up to 125cc on a full car licence.

In Queensland, Western Australia, South Australia and the Northern Territory, licensed drivers have been able to ride a 50cc scooter or moped for decades without having to do any sort of extra test.

However, in some states there are restrictions such as not carrying a pillion or riding on freeways or motorways.

Some European countries allow drivers to ride motorcycles up to 125cc and 15 horsepower such as the Honda Grom and Monkey bikes and the Kawasaki Z125 with little or no extra training or licensing.

The Federation of European Motorcyclists’ Associations conducted a survey to see whether this should be extended to all of Europe and found riders largely agreed.

However, they say drivers should take some motorcycle lessons. There is no such requirement in Australia.

Several rider representation groups have called for competency training for car drivers to be allowed to ride.

University safety researcher and Triumph Street Triple ride Ross Blackman confirms that many riders believe moped riders should be required to have a motorcycle licence.

“I’m not sure that this is supported by the stats, acknowledging that non-injury crashes are generally not reported,” he says.

“Something that muddies the waters here now is the rise of electric bicycles which, operationally, are similar to mopeds in terms of trip purpose etc.”

There have been no changes to the moped rules over the past few decades, despite most states reviewing their motorcycle licensing.

A Queensland Transport and Main Roads spokesperson says a 2012 review of moped licensing found the severity of moped crashes was lower overall compared with motorcycles.

This research determined there was no requirement for changes to licensing requirements.

However, we note that there may be significantly fewer people riding mopeds on car licences.

It is impossible to gauge exact numbers given many may only hire them.

Queensland registration statistics also don’t different mopeds from motorcycles.

Western Australia’s Department of Transport also reviewed moped licensing in 2014.

“Discontinuing moped operation on a car licence was not supported due to there being little evidence that moped riders in WA were overrepresented in crashes compared to other powered two wheelers,” a spokesperson says.

“DoT would reconsider moped operation on a car licence should data show that moped riders are overrepresented in crashes in WA, and that there was evidence to support that discontinuing the approach would result in considerable road safety benefits.”

WA registration stats show a 33% increase in moped registrations from 2011 to 2015.

“This could have been attributed to an increase in traffic congestion, lack of available parking, need for economical and convenient transport and that the holder of any valid class of driver s licence is also authorised to ride a moped,” the spokesperson says.

We can see pros and cons in allowing drivers to ride mopeds.

On the positive side, it’s great for tourist areas where foreigners can hire a moped to get around.

It also allows drivers to experience the thrill of riding and hopefully encourage them to go for their full licence.

The licensing also allows inner-city residents to get around cheaply and conveniently without the expense of a motorcycle licence they may never need.

There is also a host of great light electric motorcycles and scooters hitting the market that qualify under the moped rules.

On the negative side, we see a lot of stupid moped riders doing some dangerous and illegal things on the roads.

An example is filtering. It is illegal to filter unless you are a fully licensed rider, for a start.

Secondly, we see moped riders filter to the front of a queue of traffic at the lights only to hold everyone up when the lights go green because of their slow acceleration.

Unfortunately, the ire drivers feel toward some idiot moped riders filters across to legal and sensible motorcyclists!

Should motorcycle rider age be lowered?

While some states want potential riders to first obtain a car licence before getting a bike licence, Germany has lowered its riding age from 16 to 15.

Riding age varies throughout the world with Kosovo allowing riders and drivers on the road from the age of 12!

Lower licence age?

While that might seem extreme, several countries have restricted licences for riders aged in their mid teens.

The notion is that if they can ride a bicycle on the road without a licence, why not let them ride a low-powered moped, scooter or motorcycle?

That way they would learn valuable road craft lessons before graduating to a higher-powered motorcycle or other vehicle.

The German move from 16 to 15 follows a six-year trial.

They argue that since it is legal to work from 15, young people should be allowed access to a vehicle to get to work, especially in rural communities with little or no public transport.

It would also help get millennials enthused about riding motorbikes!

Germany also plans to allow any person with a full car licence to ride a motorcycle that can travel no faster than 100km/h (62mph).

It is a little more generous than moped laws in Queensland and WA where car drivers can ride a bike up to 50cc without having to pass a special test.

Australians and New Zealanders can get a motorcycle learner’s licence from the age of 16 (15 years 9 months in the ACT), except Queensland where you need a car licence for a year first.

South Australia is considering a licensing review that recommends lifting the ages for learner riders from 16 to 18 and full-licensed riders from 20 to 21.5.

While Queensland requires learner riders to first hold a provisional, P1, P2 or open car licence for a year, South Australia also suggests that riders must have a learner plate for a year.

It runs contrary to practices in some countries where 15-year-olds can first ride a two-wheeler up to 50cc before getting a car or motorcycle licence.

Moped and restricted motorcycle licence ages in Europe are: 14 in Latvia and Estonia; 15 in France, Czech Republic, Spain; and 16 in Portugal, Romania.

Licence age in most of Europe is 17 or 18 years.

In the USA, South Dakota allows 14-year-olds to get a learner’s permit and their full licence six months later. However, there are restrictions on engine sizes.

In most American states 15-year-olds can get a learner’s permit, a restricted licence at 16 and six months to a year later they can get a licence.

Iowa and Kansas allow 14-year-olds to get a learner’s permit but they have a two-year wait to get a restricted licence.

Mopeds don’t require a licence in the USA.

Call for time limit on rider licences

Motorcycle licences should have a time limit to reduce the risk of matured-aged returned riders crashing, a road safety summit has heard.

Victorian Road Trauma Summit was convened last week after a shocking start to the year with 26 motorcyclist deaths, nine above the five-year average of 17 and 10 more than last year. Many more have been injured and there has been a spate of hit-and-run accidents leaving riders dead or injured.

While motorcycle safety only played a small part in the summit discussions, there was a suggestion by one female academic that returned riders were over-represented in the statistics.

The issue was that motorcycle licences don’t expire, which allows mature-aged riders to return after a long spell off the motorcycle with no retraining required.

The summit heard a suggestion that a time limit be imposed on motorcycle licences of 10 to 20 years if the licence holder does not own a registered motorcycle or scooter. 

It was suggested that to keep the licence, riders be required to do a one-day training refresher course that focuses on potential risks for riders.

This is not a new suggestion.

It has also been suggested that mature-aged riders would need training in modern motorcycle technologies such as ABS and introduce them to new road laws such as lane filtering.

However, Victorian Motorcycle Council media spokesman John Eacott has previously pointed out that police and road safety authority claims that returned riders are the biggest safety risk on the road is a “furphy”. 

His analysis of Traffic Accident Commission statistics showed that older riders account for less than 50% of fatals and hospitalisations yet comprise 70% of licensed riders.

Motorcycle Riders Association of Victoria spokesman Damien Codognotto says the subject of limited motorcycle licences is a “Trojan Horse”. 

“It opens a door to licence restrictions on road riders and making it look like riders initiated moves to make it harder to hold a bike licence,” he says. 

He says car drivers of similar ages drive much heavier machines that can do a lot more damage.

“There are many many more of them than there are bike riders and they are involved in many more serious injury crashes,” he says.

Safety summit

The state government’s summit included experts from the TAC, VicRoads, VicPol, MUARC, RACV, Road Trauma Support Services Victoria and cycling and motorcycle advocates including the Victorian Motorcycle Council and the Motorcycle Expert Advisory Panel.

It will be followed by community roundtables across regional Victoria where road deaths have spiked at 72 compared with 41 in metropolitan Melbourne.

The plan is part of a licensing review which also recommends lifting the ages for learner riders from 16 to 18 and full-licensed riders from 20 to 21.5.

He says “no specific evaluation of the measure has yet been undertaken”.

“RTR believe improved rider education and training are the key areas to be development in order to produce safer riders,” he says.

It may also lead drivers to ignore vulnerable road users such as motorcyclists who pose no danger to them, leading to SMIDSY crashes.

A total of 1553 participants responded to the consultation, while key road safety stakeholders, motorcycling industry representatives and other interested parties provided feedback through formal submissions.

However, he says it is difficult to argue against stricter licensing measures such as higher learner ages in the wake of increasing motorcycle rider fatality rates.

“As soon as you start going on about the idea of arguing to have less experienced or skilled riders on the road, you are on a hiding to nothing,” he says.

Rhys also rejects the idea of subsidised training courses for riders.

“The problem is most people use their motorcycle for recreation, so the argument would be why should one recreation get subsidies over another, such as gun shooting or anything else?” he asks.

“As an industry we have a difficult argument to progress.

“How does an industry body argue that they should be making it easer or subsidised.”

Rhys agrees that a recent rise in unlicensed rider crashes could be the result of tougher and more expensive licensing laws.

“People do take the risk and ride unlicensed, particularly in the bush, rather than going through the right system,” he says.

“Now in Victoria it costs over $1000 to get a licence.”

Costs are similar in other states and it takes more than a couple of years to reach full licence status. Queensland riders have to hold a car licence for a year before applying for a motorcycle licence.

Other recommendations include displaying correct plates, restricting pillions, mandatory carriage of licence, a night curfew, zero blood alcohol, a lower demerit point threshold for disqualification, no mobile phones and hi-vis vests for novices like in Victoria.

A total of 1553 participants responded to the consultation, while key road safety stakeholders, motorcycling industry representatives and other interested parties provided feedback through formal submissions.
