Cyclist passing rule a danger to motorcyclists

A rule allowing drivers to cross solid white lines to overtake cyclists has now been extended to Victoria, making it a blanket rule across all Australian states.

Back in 2016, crash victim Maritha Keyser and rider groups said the implementation of the rule was putting the lives of motorcyclists in danger.

Maritha vainly launched a petition against the rule. The petition is now closed with 2340 signatures.

In 2015, Maritha was involved in an accident when a vehicle legally crossed a double white line to pass a slow-moving cyclist and give them the required 1m buffer (or 1.5m in over 60km/h zones).

The laws actually state that you can only cross or straddle a solid white line or painted island “if it is safe to do so”.

However, the very fact that it is allowable creates the wrong impression for drivers.

Motorists already can’t see riders, don’t want to see us or simply ignore us as no real threat to them.

They wouldn’t cross a solid line if another car was coming, but they seem willing to do so for motorcycles.

Here is a video example of a close call as a rider nearly runs head-on into a van that is over the white line on a corner because of a cyclist on the side of the road.

While Maritha’s accident was not a head-on with the overtaking vehicle, its presence on the wrong side of the road led to a chain of events that caused the crash that left her with permanent disabilities.

Maritha had the support of Australian Motorcycle Council, the Victorian Motorcycle Council, BMW Clubs Australia and others.

Legislating to protect one vulnerable road user that heightens the risk of another vulnerable road user is simply wrong, they all said.

Now, the Motorcycle Rides Association of Australia has chimed in wth the introduction of the laws in Victoria.

“This is a very dangerous law on roads like the GOR, the Black & Reefton Spurs, the St Andrews / Kinglake Road and many others,” says spokesman Damien Codognotto.

“In my opinion the police crash reports on head-on and rear-end crashes will not mention bicycles in most cases so the data will be distorted in favour of the new law being effective. That is what happens with road barrier crashes. There is no oversight or control to ensure crash data is reliable.

“Double white lines are there because it is dangerous to go on the wrong side of the road where the lines are painted. On many 80 and 100 kph roads crossing double white lines creates an extremely dangerous situation. I’ve heard of at least one head-on in Queensland in these situations.
“Then there’s the danger of coming on slow moving bicyclists and braking to slow to their speed. The car/truck behind does not brake in time and hits the back of you.”

Delivery riders flouting road rules

Some motorcycle, scooter and bicycle delivery riders are flouting traffic and parking rules, endangering pedestrians and other road users, says Motorcycle Council of NSW vice-chairman Jason Antony.

He says it has worsened under the current pandemic lockdown, as more and more people use online services to order meals.

“The food delivery industry — part of the burgeoning gig economy — is in dire need of regulatory oversight as well as scrutiny from road safety authorities,” Jason says.

“As a significant number of these workers are from overseas, it would not surprise me if they do not hold an Australian licence.

“Many such riders therefore tend to be unfamiliar with, or have little regard for, Australia’s traffic system and road rules — often endangering other road users, including pedestrians, for very little gain.

“For years, I have observed them on barely roadworthy motorbikes and scooters, choosing to behave in an increasingly dangerous manner as they stare at their mobiles, focussing on text and video conversations instead of their surroundings.

“Even L-platers can be frequently seen lane filtering, lane splitting, kerb filtering, failing to give way, chucking U-turns into the path of oncoming traffic, running red lights, almost striking pedestrians who are crossing legally … the list goes on.”

Under lane filtering rules, only those who hold a full Australian motorcycle licence are permitted to lane filter, not overseas licence holders.

We asked Brisbane, Sydney and Melbourne councils if they had an issue with scooter delivery riders and whether they were over-represented in traffic and parking fines. However, they said they didn’t keep records relating to delivery riders. They also didn’t have any specific operations to keep a check on them.

Jason says the perceived lack of targeted action by the relevant authorities to hold errant delivery riders to account is perplexing.

“Over the past few years, I have observed an increase in the number of delivery riders taking more risks, breaking more road rules and creating close calls — yet we have not seen a campaign targeting them,” he says.

“The message needs to be spelled out and enforced with no wiggle room: inconsiderate, reckless and dangerous riding that puts others at needless risk will not be tolerated.”

Jason says it’s not just motorcycle and scooter delivery riders at fault.

He says many push-bike delivery riders are also illegally riding on footpaths, including many on power-assisted electric bikes despite the roads being relatively empty during the lockdown.

“They power through narrow footpaths at ridiculous speeds, speed past shop entrances and intersections, bang the bell when approaching pedestrians and frighten them out of their way — others silently scrape past those on foot with very little room to spare.”

In some states, it is illegal to ride a bicycle on pedestrian footpaths, but there are some exceptions for children.

Licensing and training

Jason says all delivery riders should be made to undertake road rules training and a defensive riding course.

“It could provide the impetus for food delivery riders to understand the responsibilities that come with operating a vehicle on the roads safely, sensibly and considerately,” he says.

“At the end of the day, it is about their safety as well — not merely the general public’s.”

He also points out that people with overseas driver/rider licences must obtain a relevant local licence after a certain period, usually three months.

Jason says this should be rigidly enforced.

10 New Year resolutions we’d like to see

Each New Year we make resolutions to do something new, better or at least different for the next year.

This year we thought we would do something different for the new decade and compile a wish list of 10 New Year resolutions we would like others to make.

We know most of these are just vain wishes, but we thought we would present them anyhow in the hope someone out there takes up at least one of them!

The list includes other motorists, but is also aimed at other riders.

Resolutions we would like others to make:

  1. Drivers should resolve to pay more attention to riders and looking out for their safety. Get off your phones, stop playing with the touchscreen on your cars instruments and use your mirrors.
  2. Caravan and truck drivers could resolve not to try to pass other vehicles on the only double-lane uphill stretch for miles around, blocking a string of traffic behind them who could have passed a lot quicker.
  3. How about riders resolving not to make disparaging comments about other people’s choice of bike? We are part of a small community, so we should stick together and support each other.

  4. Some riders could also resolve to ride within their abilities. Don’t show off or try to get your knee down on public roads. Take some responsibility for your own safety and don’t just blame other motorists.
  5. Wouldn’t it be great if cyclists resolved to not use the road as their own personal racetrack and take up most of a lane on a narrow mountain road?Cyclist identification call rejected
  6. We would also love it if governments at all levels resolved to listen to riders and include them in their planning.
  7. Drivers of all vehicles should resolve to understand that lane filtering is legal and not only a benefit to riders, but to all motorists as it reduces the number of vehicles in the commuter queue

  8. Instead of adding performance parts to your motorcycle to squeeze out more power, riders could resolve to lose some weight to improve the bike’s power-to-weight ratio, or maybe take some riding lessons to sharpen your skills. Admit it; you don’t use anywhere near all the power your bike already produces!

City speed limit down to 30km/h

Melbourne plans to drop its CBD speed limit to 30km/h, the lowest of any capital city in Australia, following a Monash University report to council.

The new speed limit will replace the 40km/h limit introduced seven years ago between Flinders, Spring, La Trobe and Spencer streets.

The university research says the lower speed will protect vulnerable cyclists and pedestrians.

In 2017, the United Nations Global Road Safety Week called on 30klm/h speed limits in all city areas, citing World Health Organisation claims that a 5% cut in speed would result in a 30% reduction in the number of fatal road traffic crashes.

Victorian Motorcycle Council chairman Peter Baulch says that while road safety is a shared responsibility of all road users, “pedestrians have a responsibility to be fully aware of their surroundings at all times, without distractions”.

“However, for this 30km/h idea to take root and become law, it would require a change of both legislation and regulations, for which VicRoads says it has no current plans,” he says.

“Is this idea of 30km/h in the CBD another case of punishing the masses for the crimes of a few? 

“VicPolice and the media generally report that many pedestrian incidents are the result of pedestrians being distracted by devices (phones, tablets, etc, often with earphones), which affects their ability to both see where they are walking and hear what is around them. 

“A cynic may even suggest this is a plan to rid the CBD of vehicles all together.

“It’s time for pedestrians to be more disciplined and less distracted, like they were when probationary constables patrolled CBD intersections and pedestrian crossings.”

Longtime motorcycle advocate Rodney Brown says he believes Mayor Sally Capp’s strategy is to “have a city full of pushbike riders and thousands of hoops clogging up the footpaths”.

“Certainly it will not be a friendly city for motorists,” he says. 

“Pushbike riders and pedestrians need to know and obey the road rules and police need to concentrate on those walking blindly while texting, talking on their mobile phones, ignoring stop-walk signals/signs and J-walkers.

“Police need to fine pushbike riders who believe a speed limit doesn’t include them. Maybe pushbikes need a speedo.

“Lowering the speed limit to 30km/h may encourage pushbike riders and pedestrians to take more risks.

“Melbourne City Council needs to run an advertising campaign encouraging pushbike riders and pedestrians to be more responsible with regards to their own safety when navigating in and around the City of Melbourne.”

The Monash report on CBD speeds follows a council review of central Melbourne transport.

Among the recommendations in the City of Melbourne’s transport strategy due for release next month is moving motorcycle parking from the footpaths to the streets.

Cyclist identification proposal rejected

Tasmanian Motorcycle Council proposal for free identification numbers for cyclists over 18 has been rejected.

Council president Paul Bullock confirms the Tasmanian Road Safety Advisory Council discussed the TMC’s policy proposal.

“RSAC did not endorse the proposal,” he says.

“Discussions identified that it might be timely to develop a campaign about all road users sharing the roads.

“RSAC referred this to the Education and Enforcement Sub Committee (EESC) for consideration within its priorities.

“Identification has been passed on to a sub committee of the RSAC ‘for consideration within its priorities’, so it will be a low priority.

“But I will be following and asking what is happening at every RSAC meeting you can be assured of that.”

The rejected TMC call for cyclist ID is based on cyclists disobeying road rules and not being fined.

The rejected TMC proposal did NOT suggest cyclists pay registration fees.

“Cyclists don’t understand it is for identification, not registration. It is to stop cyclists breaking the law. At no cost to the cyclist,” Paul told us when the TMC made the suggestion in January.

The TMC wanted cyclists over 18 to wear some form of reflective identification number on their bike, clothing or helmet. Paul says it could be funded through the road safety levy.

Rule breakers

What seems to irk many motorists is that cyclists get political favour, their own lanes, free footpath parking and yet avoid traffic offences.

Paul says the TMC posted the following video of cyclists disobeying roundabout give-way rules.

However, cyclists are not avoiding traffic fines altogether.

In the past two years, Queensland Police alone have booked more than 230 cyclists for speeding and 540 for running red lights.

The TMC also provided this list of traffic offences in Tasmania by cyclists:

“They obstruct vehicles travelling on the road; while travelling in a group doing far less speed compared to other vehicles, they will not move into single file to allow vehicles to pass.

“Cyclists use the excuse that they are entitled to ride two abreast on the road, while failing to accept that they are unreasonably obstructing traffic, which is illegal.

“Despite it being legal for cyclists to travel two abreast and laws allowing other vehicle to cross double lines to pass when safe to do so, irresponsible and discourteous rider behaviour puts cyclists and other road users at risk.”

With identification numbers, more traffic offences could be issued, more than paying for the cost to implement the program, Paul says.

Last year, a Change.org petition was started by Drivers For Registration of Cyclists for cyclists to ride single file.

It has so far received more than 136,000 signatures.

Should cyclists wear identification?

It’s an old complaint about cyclists disobeying road rules and not being fined that surfaces every now and then.

Council president Paul Bullock says his call follows “many complaints” from motorcyclists, car drivers, bus drivers and truck drivers about cyclists who behave irresponsibly.

Call for traffic light activation buttons

Riders whose bikes won’t trigger a change in a traffic light to green would welcome more of these activation buttons that have been installed at some intersections for cyclists.

It seems cyclists get everything they want from governments. Even their own roads!

In this case, their strong lobbying for these buttons may also help motorcyclists.

They are located on poles close to the road so riders can push them and trigger a change in the traffic lights.

These have been installed because many modern bicycles are made of carbon fibre which will not trigger traffic light sensors.

There are varying types of sensors used around the world but the most common is called an inductor loop. It consists of a wire loop placed in the asphalt leaving a telltale rectangular cutting in the road surface to detect the metal in the engine block.

However, some are not sensitive enough to pick up small motorcycles. Also, many modern motorcycles have a lot of alloy which reduces their ability to trigger the lights.

Motorcycle Council of NSW chairman Steve Pearce says they have discussed the issue with Roads and Maritime Services.

“So far we have not received a reply except that they are looking into it,” he says.

“Our suggestion was actually a pressure pad at the front of the lane which would be triggered by a motorcycle.

“As the weight of a motorcycle is less than a vehicle, it would need to be a bespoke item.”

Report traffic light problems

RACQ safety and technical manager Steve Spalding says they have also raised the issue of motorcycles not triggering traffic lights with Transport and Main Roads “a couple of times”.

“Their advice is to report the lights to the relevant road authority for attention,” he says.

“They told me they can adjust the sensitivity but if they adjust too much it can then pick up traffic passing in an adjacent lane.”

Rider advice

Steve advises riders to correctly position their motorcycle over the cut lines in the road where the loop sensors are placed.

“Don’t stop in between them,” he says.

“You can also try moving forward to allow a car to position over them if they won’t trigger.

“From a safety perspective I’d suggest a rider not stop over the cut line closest to the adjacent through-lane but position themselves over one of the other lines (there are usually three running parallel to the lane).

“This gives them a bit more of a safe space if a passing car runs too close, or drifts into, the turning lane where they are sitting waiting for a turn light.”

Several American states allow riders to proceed through a red light that has not triggered so long as they have stopped first.

There are also places where all motorists are allowed to turn left (or right in countries where they drive on the right) on a red signal.
